CHARLESTON, WV — A Logan County physician was found guilty of drug charges following a four-day trial after being accused of overprescribing controlled medications, according to court records.
Brian McDevitt, 61, of Chapmanville, was found guilty by a federal jury after writing prescriptions for hydrocodone, an opioid, on May 17, 2022 and March 29, 2024, and Xanax, a depressant, on May 18, 2022 and March 29, 2024, according to a release from the U.S. Attorney’s Office, Southern District of West Virginia.
McDevitt previously pleaded guilty to charges in January 2010 for allowing others to use his federal registration number to distribute prescription diet drugs while benefitting from the transaction. He was sentenced to one year and one day in prison, three years of supervised release, and a $60,000 fine.
“Dr. McDevitt was one of the original drug dealers in a lab coat, and he did not learn his lesson from his prior convictions and prison sentence,” US Attorney Will Thompson said in a statement. “Instead, he chose to continue violating his ethical duties and responsibilities as a physician to enrich himself at the expense of vulnerable West Virginians.”
